MOUNT SAINT MICHAEL KICKS BACK

Christopher White was injured while playing line soccer in a high school gym class.

In a lawsuit filed in the Bronx County Supreme Court, White alleged that the school -- Mount Saint Michael -- was guilty of "negligent supervision."

When the school moved to dismiss the case, the Bronx County Supreme denied the request, finding issues of fact which required a hearing or trial. On appeal, the Appellate Division, First Department, reversed.

Since the the injury was a result of a "spontaneous and unforeseeable act," the AD1 was of the opinion that no liability could attach and that the negligence suit needed to be kicked out of court.

Established in 1926, the school counts among its alums, 1987 graduate  Sean John Combs a/k/a Diddy, a/k/a P. Diddy, a/k/a Puff Daddy, a/k/a Sean "Puffy" Combs.
