IS LOPEZ-TORRES HEADING TO U.S. SUPREME COURT?

NEWS FLASH!

The New York State Board of Elections, the New York County Democratic Committee, the New York Republican State Committee, and the Associations of New York State Supreme Court Justices in the City and State of New York (among others) have filed a Petition for Writ of Certiorari seeking to appeal the case of Margarita Lopez-Torres v. New York State Board of Elections to the United States Supreme Court--our nation's highest court.

As you may recall, Judge Lopez-Torres had filed a federal lawsuit challenging the manner in which New York Supreme Court Justices were nominated for election. Both the United States District Court for the Eastern District of New York (John Gleeson, Judge) and the United States Court of Appeals for the Second Circuit determined that the nominating process--known as the "judicial convention system"--was constitutionally violative and thus required remediative action by the New York State Legislature.
