A BARRED RELATIONSHIP
Nakia Thompson, an inmate at the Bedford Hills Correctional Facility, alleged that she was repeatedly raped by a corrections officer and sued the State of New York claiming that prison officials had negligently supervised that individual.
While an internal investigation substantiated an unathorized relationship, the sexual component could not be independently verified.
After the Court of Claims dismissed her case, Nakia appealed to the Appellate Division, Second Department.
Since the only evidence of the rape was Nakia's own testimony (which wasn't found to be credible), the AD2 deferred to the trial court's credibility findings and allowed the dismissal to stand.
